The first volume of the official collection of rulings of the Court of Cassation of the Duchy of Warsaw, printed at the Government Printing Office in Warsaw. The volume comprises seven sections and 92 issues from the years 1810–1811, with continuous pagination. The title “Journal of Decrees” appears on the title page of the first section; in an errata attached to No. 25 (1811), it was corrected to “Journal of Judgments,” and subsequent sections as well as Volume II (1812)—the last to be published—appeared under this title.
The 1807 Constitution of the Duchy of Warsaw entrusted the duties of the Court of Cassation to the Council of State, with the participation of four referendaries appointed by the king (Art. 72). The Court of Cassation operated on the basis of a decree by King Frederick Augustus dated April 3, 1810, and inaugurated its activities with a ceremonial session on June 19, 1810. It heard appeals against final judgments of civil and criminal courts, as well as jurisdictional disputes between courts. It published its final ruling on October 16, 1812, and in 1813, the Council of State was replaced by the Russian Supreme Provisional Council. The Court’s case law, published in this volume, remains a subject of study for legal historians to this day.
A must-have for legal historians, researchers of the history of the Duchy of Warsaw, and collectors of Polish legal prints from the Napoleonic era.
The title page has been reinforced with pieces of new paper; the corners of the first 8 and last pages have been repaired; there is a water stain starting in the middle of the block and becoming more pronounced toward the end. The binding is in good condition.
